2. Eligibility

You must be at least 18 years old to create an account and use the platform. Teens aged 13–17 may use the platform with the supervision of a parent or legal guardian who holds the account.

Users are responsible for ensuring their account information is accurate and up to date, as well as safeguarding their login credentials.

3. Creating and Using an Account

By creating an account on Kraahl, you agree to:

• Provide accurate and truthful information during registration.
• Maintain confidentiality of your account credentials.
• Use your account in compliance with these Terms and all Policies.

Prohibited activities include:

• Creating multiple accounts without permission.
• Using another User’s account without authorization.
• Engaging in fraudulent activity or misrepresentation.

4. Listings, Posts, and Transactions

Sellers must provide accurate descriptions, pricing, and photos of items. Sellers are responsible for ensuring their items comply with all applicable laws and regulations.

Users can create Posts to share photos, text, and engage with the Kraahl community, provided the content adheres to our Community Guidelines.

Buyers are responsible for reviewing Listings carefully before making purchases. Sellers are responsible for shipping items promptly and accurately. Disputes between Buyers and Sellers should first be resolved directly or via PayPal’s resolution center.

5. Fees

Processing Fee (Seller): Sellers are charged a processing fee, a percentage of the transaction value, as outlined in the platform’s Fee Schedule. This percentage is subject to change over time and will be communicated via updates to the Fee Schedule.

Service Fee (Buyer): Buyers may also be charged a service fee for using the platform, calculated as a percentage of the purchase price. The service fee amount is likewise subject to change and will be reflected in the Fee Schedule.

Fee Changes: The platform reserves the right to modify the Processing Fee, Service Fee, or other applicable charges at any time. Fee adjustments will take effect after being announced via updates to the Fee Schedule and Terms of Service.

6. Payments

Payment Processing: All payments are processed securely through PayPal. Users must link a valid PayPal account to engage in Transactions. By using PayPal, Users agree to its terms and conditions.

Taxes and Fees: Buyers are responsible for any applicable taxes, shipping fees, and other costs. Kraahl collects applicable platform fees automatically at the point of sale.

7. Acceptable Use Policy (AUP)

Prohibited Items:

• Adult Materials: Content or items of an explicit or pornographic nature are strictly forbidden.
• Counterfeit and Unauthorized Goods: Selling counterfeit or unauthorized items, including replicas of branded goods, is prohibited.
• Regulated Goods: Items subject to government regulation (e.g., alcohol, tobacco, firearms) are prohibited unless you comply with all applicable laws and provide proof of authorization.
• Pre-Orders: Users may only list items currently in their possession; pre-orders are not allowed.

Prohibited Activities:

• Posting or sharing content that is defamatory, obscene, harmful, or violates laws or platform policies.
• Circumventing platform fees by soliciting off-platform Transactions.
• Engaging in fraudulent, illegal, or harmful activities.
• Exploiting or harming minors, including soliciting personal data or sharing inappropriate content.
• Spamming, phishing, or engaging in other malicious online behavior.
• Misrepresenting the condition, authenticity, or legality of any item in Listings.
• Sharing false or misleading information in Posts, Listings, or communications with other Users.

Intellectual Property:

• Unauthorized Use: Users must not use copyrighted or trademarked materials, including images, logos, or descriptions, without explicit permission from the rights holder.
• Original Photos Only: All Listing photos must be original and represent the actual item being sold. Use of stock photos or misleading images is prohibited.

Kraahl reserves the right to remove content, terminate accounts, or take other necessary action to enforce these guidelines.

8. Intellectual Property and Copyright Policy

Ownership of Content:

All content available on Kraahl, including text, images, logos, and trademarks, is the property of Kraahl SASU or its licensors. Unauthorized use, reproduction, or distribution of this content is strictly prohibited.

User Content:

Users retain ownership of any original content they upload (e.g., photos, text in posts) but grant Kraahl a non-exclusive, royalty-free, and worldwide license to use, display, and promote the content in connection with the platform.

DMCA and Copyright Complaints:

If you believe content on Kraahl infringes your intellectual property rights, please contact contact@kraahl.com with:

• A description of the copyrighted work or material you believe is being infringed.
• The location (URL) of the allegedly infringing content.
• Your contact details (name, address, email).
• A statement under penalty of perjury that the information provided is accurate and you are authorized to act on behalf of the copyright owner.

9. Shipping and Delivery

Sellers are responsible for shipping items in a timely manner to the Buyer’s provided address.

Kraahl is not liable for delays, lost shipments, or items damaged in transit.

Buyers and Sellers must resolve shipping disputes directly or through PayPal.

10. Limitation of Liability

Kraahl is not responsible for:

• Accuracy of item descriptions or photos provided by Sellers.
• Disputes or issues between Buyers and Sellers.
• Losses resulting from unauthorized account access.
• Items lost, damaged, or delayed during shipping.

11. Privacy

Kraahl respects your privacy and handles your personal data in accordance with our Privacy Policy.

12. Updates to Terms

Kraahl may update these Terms at any time. Users will be notified of significant changes via the Site or email. Continued use of the platform after updates are posted constitutes acceptance of the revised Terms.
